Frequently Asked Questions - Child Custody

  • Can the parties agree on how custody will be shared? Yes. In fact, it is often better if the parties do agree on the custody arrangement. Often the parties know what is best for their child(ren). If the parties can agree, the lawyers can draft the appropriate documents and the matter can be resolved quickly.
  • If the parties can't agree on the custodial arrangement, what happens? The parties will have a hearing in front of a district court judge. The judge will listen to the evidence presented by both parties and them make a decision regarding the custodial arrangement based on what the judge believes is in the best interest of the child(ren).
  • What is a primary custodial parent and what is a secondary custodial parent? The primary custodial parent is the parent that the child(ren) live with the majority of the time. The secondary custodial parent is the parent that has the child(ren) for a reduced period of time. The secondary custodial parent ususally has physical custody of the child(ren) every other weekend, one-half of the holidays and for a few weeks in the summer. The rest of the time the child(ren) live with the primary custodial parent.
  • At what age can a child choose which parent the child would like to live with? There is not an age per se at which a child can choose the parent the child would like to live with. However, as a child gets older the wishes of the child are taken into consideration by the judge. The weight given to the child's wishes differs from case to case and largely depends on both the age of the child and the maturity of the child.
  • Can my spouse have members of the opposite sex spend the night in the house when my child is present? Typically the Court will place a provision in the Custody Order that prohibits either party from having a member of the opposite sex not related by blood or marriage spend the night while the children are present. This is especially true if one of the parties requests this provision to be added.
